The  Economist Intelligence Unit recently published report provides a good quick read, which Directors and Senior Executives should find useful in thinking about questions they should be asking their CIO about their organisation’ s cyber attack prevention and attack recovery strategies.

The most telling finding in my view is that “The level of preparedness is being held back by a lack of understanding about threats.”

Directors need to understand technology so they can understand the threats and then take a governance oversight of the risk management the business has in place.

Directors who do not understand technology and who are not interested in learning, should think about safer occupations. The rise in activist shareholders could mean more private prosecutions of Directors who fail in their governance oversight role in protecting business from economic damage.

The new Health and Safety Reform Act 2014 which is likely to come into force on 1 April 2015, will have major implications for businesses, charities and NFPs. If your organisation relies on a Board or similar group of non executives for governance you need to understand what this means for your organisation, on top of what the Bill means for the way you keep your staff safe.

SONY DSCIn the tough times many organisations let their admin assistants and PAs go. Trouble is, our organisations now have, at senior levels, more two finger typists than ever before. Those who let the PAs go worked in an age when the PC was not necessarily the dominate player on every desk. It was possible for them to make do without a dedicated PA. Now the senior ranks across the world is full of men and women who did not learn typing at school and use some variant of the peck. My partner is constantly disturbed at my attacks at the keyboard as if it was an old Remington ball typewriter! I tried typing lessons but the boredom nearly finished me off and I learned to love the value of support.

Seems to me the time has come to rethink how we resource our organisations as economies take a turn for the better. If you pay hundreds of thousands of dollars for executives, why would you force them to do admin work themselves inefficiently and possibly badly.  Lawyers are a great example of highly paid professionals who command high rates for each hour they deliver to clients, yet if you walk around the average law firm you will see many lawyers typing slowly and incompetently at your expense! Great customer experience’s are supported by having the right people doing the right things at the right level of competence.

The discovery that got me thinking along this line this morning was TripIt’s new amazing service that loads up all your travel details into your TripIt account off a pdf of an itinerary or e-ticket in seconds, just by emailing it to them. If you have never tried TripIt, have a go and be amazed at the speed.

This certainly will help all of those who are managing their work without admin assistance or those with a PA who dare not ask with help arranging their vacations. Then it might be time for a 60s style time and motion study and see how much time and money your organisation wastes by not valuing support staff enough.

If there is a problem encouraging bright students into STEM (Science Technology Engineering Maths), there is an even bigger problem encouraging young women in.

Today marks Ada Lovelace Day which celebrates the successes of women in science, technology, engineering and maths. Ada Lovelace is often referred to as the first computer programmer, after her work on Charles Babbage’s early general-purpose computer. As we celebrate the achievements of women in STEM, there is an opportunity for a discussion around the need for more of our young people and in particular more young women to choose careers in STEM, over traditional professions such as law.

Brydie Meinung is a great exponent of women in technology working where entertainment people and technology meet. She is a great example for young women thinking of career choices. I say pick technology and not the law if you want a satisfying rewarding ever-changing career. Time we all got together and directed our smartest students away from a fading career.

Last week was a big week. It was New Zealand’s Leadership Week. On Thursday night it was the “Dinner with a Difference” organised by Leadership New Zealand. http://www.dinnerwithadifference.co.nz/  I was Dinner MC and our theme and approach was all about disrupting thinking, disrupting the status quo and disruptive leadership. My co-host was a Guide Dog Breeding Mum called Eppie!

In my opening framing speech, I shared a story of a school visit to William Morris’ Red House in England. In cahoots with Joyce Bennett the “push the boundaries” new girl in my class we decided to have a shot a disrupting. Being a bit of a goody goody (then not now) I proposed we become extra good and swotty. We walked very slowly around the house admiring everything and asking lots of interested and intelligent questions. The outcome was that we made the whole class an hour late home and even kept the house open. The history teacher Mrs Harris hissed at us saying “I know what you are playing at” , but that was all she could do. We were holding the immunity idol. At that time I realised  that there are many ways to cut the cake and some are much more satisfying than the obvious.

During the dinner break at the Dinner with a Difference I was approached by one of the Professors from AUT University Business School (our hosts for the night) who said that he had been a volunteer in Red House years back! Luckily he did not remember that day!

Interesting reminder that the World is seriously small and global travel means we could meet people from the past at any time. I often remind people wearing my lawyer hat never to write anything in an email that will be a problem if it appears in the Herald. Good reminder also never to behave in a way that you cannot justify or laugh about in years to come, even if you move across the World to a place that does not even feature on the CNN weather map.

Interesting thing about that school trip-it is virtually the only one I remember and I remain an admirer of William Morris’ work and his courage to disrupt the Art scene, to this day.  Seems disruptive approaches really do resonate in our brains.

The other involvement I had in Leadership Week, was being part of the Dream Team for the Sir Peter Blake Trust http://www.sirpeterblaketrust.org  Along with 300 others we went out to schools and talked about the opportunities that could come from Daring Dreaming and Doing. This threw the challenge out to me as to what is my Dream that I am doing and what would I suggest or recommend to 17 and 18 year old girls.

I can report that my thinking was sufficiently disrupted in my prep and I was disruptive in my advice.

On the one hand I said be sure the Dream you are pursuing is your dream and not someone else’s (whether they be parent teacher or anyone else). I meet too many young people saddled with debt from study that was someone else’s aspiration. Then I said do not be put off by people who say that is a dumb dream or that you are not good enough to do whatever it is. Have the courage to carry it through and not miss opportunities from fear or uncertainty. I also said do your homework and research and check out that the job, career or dream is actually what you think it is and then I said wanting to be a lawyer is a bad idea!

We are heading to a crisis with too many parents and young people believing law is still the golden career and a guarantee of riches. I meet too many lawyers earning less than a teacher but no-one speaks out from pride. We need our young people to see the opportunities to change the World that come from technology and science and careers not yet invented.

Bored Lawyer Pub_2I realised from all this pondering that I am the fortunate one who practices law (along with other things totally different) as and when I want in the way I want and for clients who get disruptive thinking. I dreamt I dared and I do and I am lucky.

I am off now to see what further disruption I can achieve. Happy Bastille Day and my thoughts are with the people in France affected by the horrible holiday weekend train crash.

Social Sentinels #socialsentinels the new alternative to having more board directors for NFPs and social enterprises

I worry that our Not for Profits (NFPs) and Social Enterprises have Boards of Directors/Boards of Trustees etc with too many people on them.

I also wonder how many people are on NFP boards because it looks good on their CV and I then wonder how many NFPs invited people onto their  board hoping for hands on help, support and influence and just ended up with another pain in the ….. around the board table?

DSC_0056Up to now if a NFP or Social Enterprise wanted to bring on an expert pair of hands to advise, to help, to provide free assistance they would offer a Board position, unless they were one of the few with an advisory board or an equivalent.

Being a Director of anything is becoming less attractive for the Director and may not deliver the benefits the organisation was looking for.

Lovenotes http://www.lovenotes.co.nz is a Social Enterprise. It is a limited liability company but small and still finding its way. I love what they do, the vision of the business around refreshing paper appeals to my values (and provides a sustainable balance to my materialistic existence) and the creation of beautiful notebooks appeals to my love of stationary.

I have been helping Lovenotes out on a pro bono basis for about 3 years now. Lots of business advice, creative ideas and sometimes a little legal direction. We have been discussing what my role should be formally. At this stage it makes sense for Amanda to be sole director. In time I could join as a Director and/or Chair but the business is too small and what they need are my ideas, not governance.

We have come up with a new title “Social Sentinel”. A Social Sentinel is an expert in their field who is interested in and relates to the vision of the social enterprise or NFP and who provides practical hands on help and support primarily on a pro bono basis (but not necessarily) . Social Sentinels care and keeping a watching eye on the business and its staff and stakeholders (like a guardian/custodian but without any legacy baggage)  but who have no legal status and no legal liability. They neither run, manage nor govern but can provide expert practical help and ideas.

Does anyone else like the idea of doing this too and adopting this title?

Hopes for 2012

As 2011 trickles away I am busy looking forward to 2012. My hope is that this will be the year when lawyers take back control of the perception people have of our profession and re-establish our place as trusted authorities.

As the rain falls and the summer is looking a little soggy I am saddened at the families whose lives will never be the same as a result of poor driving and bad decision making by our young drivers.  I hope that 2012 will see better communication with our young with messages that resonate and which are attuned to the world they live in and not just ours.

My focus for 2012 is on a few areas:

  • Helping my current clients do good business;
  • Introducing many small businesses to legal issues so they can get on with doing their  business;
  • Helping clever technical people better communicate their thoughts and ideas and thereby increasing their ability to influence; and
  • helping develop our young practitioners as great lawyers and great leaders so we break the “great lawyer/hopeless leaders and managers” cycle.
